Professor Aviva Orenstein from Indiana University Maurer School of Law Presented “THOUGHTS ON WHAT THE AMERICAN EXPERIENCE IN EVIDENCE HAS TO OFFER CHINA” at the 1st International Evidence Science Seminar of CUPL

 

Invited by the Office of International Exchanges and Cooperation at Institution of Evidence Law and Forensic Science, CUPL and by the Center of Evidence Law Research and Studies at CUPL, Professor Aviva Orenstein – Professor of Law and Van Nolan Fellow from Indiana University Maurer School of Law delivered a presentation on topic of AMERICAN EVIDENCE LAW: SOME THOUGHTS ON WHAT THE AMERICAN EXPERIENCE IN EVIDENCE HAS TO OFFER CHINA, AS CHINA EXPLORES EVIDENCE REFORM for the Evidence Law Faculty at CUPL on June 26th, 2015.

Hosted by Professor Zhuhao Wang – Director of the Office of International Exchanges and Cooperation at the Evidence Institute, CUPL, Professor Orenstein’s presentation lasted about fifty minutes. The first part of the presentation was about the hallmarks of the American Evidence System, including cross-examination, power of judge, access and transparency and confrontation clause. The second part of the presentation identified major problems within American Evidence Law in criminal cases and civil cases. The last part was about what America has learned from exonerations, what is not recommended for export, procedures and problems worth comparing between China and America.

After the presentation, Professor Baosheng Zhang, Jinxi Wang, Zhong Zhang, Fumin Chu, Hongqi Wu, Zhuhao Wang and Jing Cao from the Evidence Law Institute of CUPL had a vibrant discussion with Professor Orenstein on a widely spread topics of interest. This seminar not only broadened Chinese evidence scholars’ understandings of the American Evidence Law, but also extended a vivid, interactive relationship between the Institute of Evidence Law and Forensic Science at CUPL and Indiana University Maurer School of Law.

Started in 2014, the 2011 Plan of PRC national government – Collaborative Innovation Center of Judicial Civilization, CUPL and Indiana University Maurer School of Law jointly founded and sponsored the Academy for the Study of Chinese Law and Comparative Judicial Systems. Professor Aviva Orenstein’s CUPL trip is part of the Academy annual activities in 2015.
