【摘 要】严格印证证明模式是对传统印证证明模式的深化认识,它不仅体现了印证证明对于证据数量充分性与证据信息相互支持性的外部适用要求,还反映出印证证明内部对于证据来源、印证适用范围、印证适用程度的严格要求。司法证明模式的调整需以诉讼真实观及司法体制、程序机制的发展状况为重要考量,断然选择冒进的调整方案不具有现实可行性。破解严格印证证明模式绝对化与僵硬化的路径在于,优化印证证明的适用,促进心证的融合运用,即根据案件的证据构造特点、犯罪严重程度、被追诉人的认罪情况,对案件区分适用不同要求的证明方式,但这不意味着降低法定的证明标准。同时,需要完善相关配套措施,强化程序保障机制与加强经验法则的运用。

【Abstract】The strict corroboration model is a deepening understanding of the traditional corroboration model,which not only reflects the external applicable requirements of corroboration for the adequacy of evidence quantity and the mutual support of evidence information, but also reflects the internal strict requirements for the source of evidence, the scope and the degree of corroboration application. It is not feasible to choose rash adjustment plans,because the adjustment of judicial proof model needs to take the concept of litigation truth and the development of judicial system and procedural mechanism as an important consideration. The path to cracking the absolutization and rigidity of the strict corroboration model lies in optimizing the application of corroboration and promoting the integrated application of inner conviction, that is, according to the structural characteristics of evidence of the case, the severity of crime and the confession of the accused, different proof methods with different requirements are applied to the case, but this does not mean that the legal standard of proof is reduced. At the same time, it is necessary to improve the relevant supporting measures, strengthen the procedural guarantee mechanism and strengthen the application of the rules of thumb.
