【摘 要】自由心证是司法裁判的必然要求,是指事实裁判者对证据的证明力进行自由评价以达到内心确信从而对案件事实做出认定的活动。作为主体的事实裁判者、作为对象的证据的证明力、作为方法或者依据的经验法则和逻辑法则以及作为结果的内心确信这四个方面构成了自由心证的基本要素。从实质上说,我国的证据评价同样应当遵循自由心证。

【Abstract】Free Evaluation of Evidence Through Inner Conviction, as the fundamental requirement of adjudication, means that the fact finder can evaluate the weight of evidence freely according to conscience and reason, and confirm the fact until he truly believes he has found the truth in his heart. The basic elements of this principle are fact finder, weight of evidence, experience rule and logic rule, and inner conviction. Evidence evaluation in China, in essence, follows the principle of free evaluation of evidence through inner conviction.
