【摘 要】全国迄今为止无统一的刑事责任能力评定标准,司法精神病学鉴定中,迫切需要一个医学与法学相结合的评定大纲,根据这一现实需求,笔者医法结合,还借鉴了法治国家的先进经验,拟定了一个建议稿供同仁批评指正。

【Abstract】There is an urgent need for an assessment guideline of ability of taking criminal responsibility in forensic psychiatry’s practice, but, until now such guideline is still unavailable. Driven by the need, and based on the experience of countries ruled by law, the author, combining the law and psychiatry, works out a proposed guideline.
