———以杨××诉胡××侵犯名誉权一案为例

【摘 要】本文运用语言学(词汇学、语义学、语体学及修辞学等)和传播学( 口语传播学与大众传播学)的相关知识对“杨××状告胡××一案”中的两处言词证据做了分析,认为:⑴在一审中,原告发给被告的手机短信具有性暗示的性质;⑵在上诉状中,辩方律师认为“网络日志( 博客) ”与传统日志的性质相同是不准确的, 被告的博客具有大众传播的性质。

【Abstract】This article uses relevant knowledge of linguistics (lexicology, semantics, stylistics, rhetoric, etc.) and communication (speech communication and mass communication) to analyze two pieces of oral evidences in the lawsuit of Yang against Hu.It argues: (1)that, during the first instance, the text message sent by the plaintiff to the defendant through cell phone bears the nature of sexual implication; and (2) that, in the petition for appeal, the counsel for the defense argues that it is inaccurate to say blog and traditional log are same in nature. Instead, the blog of the defendant is of the nature of mass communication.
