【摘 要】 鉴于医疗活动的特点、医疗诉讼专业性、医疗诉讼中证据偏在严重以及医疗界“沉默共谋”现象，有必要对医疗诉讼中的证明妨碍行为进行规制。 争议发生后及时进行实物、病历资料的封存以及尸检等对于医疗争议的解决具有重要的意义，在医疗诉讼领域的要运用证明妨碍理论进行处理。

【Abstract】 In view of characteristics of medical care activities, expertise of medical lawsuit, emphasis on the severity in evidence and conspiracy of silence, legislation of obstruction to proof in medical lawsuit becomes very necessary. Timely records sealing，material sealing and autopsy plays a very important role in resolving medical disputes. Obstruction to proof should be applied in medical lawsuit.
