【摘 要】 从学界争议和各地实践来看，医疗损害鉴定主体的改革分歧巨大。 从实践的角度而言，目前应当更多关注医疗损害鉴定程序的改革。文章对北京、上海、广东、江苏和浙江五地的医疗损害鉴定程序改革进行梳理，分析了医疗损害鉴定程序目前存在的问题：对鉴定人中立性的保障不足、公正程序的最大要素———参与的构建存在不平衡、对鉴定意见的科学性的保障的认识和制度构建都有待提高。文章从启动权、受理标准、增加专家学科专业确定的预审查环节、回避制度、异地鉴定和网络鉴定等方面提出了医疗损害鉴定程序改革的具体建议。

【Abstract】 The academic controversy and practice in different provinces reveal the great difference in the reform of the subject of authentication for medical malpractice. At present, it is practical that we pay more attention to the procedures. The essay studies the reforms in Beijing, Shanghai, Guangdong, Jiangsu and Zhejiang and analyses the procedural problems. The problems include insufficiency of guarantee of neutrality, imbalance of participation which is the most important element of procedure justice, insufficiency of understanding and construction of guarantee of scientific conclusions. The essay puts forward suggestions including the initiation right to the parties, the acceptance criteria, the designing of pre-check to define the fields of experts, the challenge system,the remote authentication and network authentication.
