【摘 要】 受观念、传统、制度、体制等因素的影响，刑事诉讼中，公安司法机关仍然带有浓厚的“口供情结”，侦查、审查起诉和审判多是围绕口供而展开，并将口供作为定案处理的主要依据，形成了口供中心主义 的理念和办案方式。 口供中心主义虽然能保证绝大多数案件的正确处理，节约刑事诉讼的直接成本，但却异 化了诉讼构造，增加了错误成本，损害了过程利益，导致刑讯逼供不止，冤假错案不断。 为此，应当在对口供进 行科学定位的基础上，在程序法中构建激励型的取供机制，在证据法中确立“不轻信口供”的口供运用机制，逐步推动口供运用理念及方式的根本变革。

【Abstract】 Influenced by traditional conceptions and institutional factors, the judicial authority, for instance,the public security organs still have a strong complex on oral confession in criminal proceedings, where the investigations, prosecutions and judgment are in some cases centered on the oral confessions. Oral confession is often improperly used as predominant evidence in verdict-making, thus leading to the formation of the “oral confession worship” in legal ideas and case-handling practices. Proper stress on oral confession ensures the correct and efficient handling of most criminal cases, oral confession worship, however, warps the prosecution structures, increases the error costs, impairs the benefits in the process, thus breeds frequent and various forms of torture and results in erroneous and unjust judgments. Considering this, this paper proposes that on the basis of a proper evaluation of the role of oral confession, a mechanism be established in the procedural law to ensure that oral confession be prudently applied so as to promote step by step the reform in ideas and methods of applying the oral confession.
