【摘 要】 在非法证据排除规则确立后，审前重复供述的排除问题浮出水面。 从确保非法证据排除规则有效实施、消极的实证真实发现主义、人权保障以及遏制刑讯的角度看，审前重复供述应该排除。 非法取证行为的持续影响效力理论是排除审前重复供述的依据， 排除审前重复供述的标准是刑讯逼供等非法行为与重复供述之间存在因果关系。 具体来说，排除重复供述，需要有刑讯逼供等非法取供行为，且该行为对被追诉人产生了较大影响，使其供述自由受到了较大限制。排除非法口供后，可反驳地推定重复供述不具有可采性。控方如欲使用重复供述，需要证明不存在因果关系。 排除重复供述可能会遇到诸多障碍，需要通过法官独立司法维护司法公正。

【Abstract】 After the exclusionary rule of illegal evidence was established，the problems of excluding pre-trial

repeated confession surface. From the perspectives of ensuring the effective implementation of the exclusionaryrule of illegal evidence，passive substantial truism，protecting the human rights and curbing inquisition by torture,the pre-trial repeated confessions should be excluded. The effect theory of the continuing impact from the behavior of illegally obtaining evidence is the basis of excluding pre-trial repeated confessions，and the standard of excluding pre-trial repeated confessions is the causal relationship between illegal acts such as extorting confessions by torture and repeated confessions. Specifically，to exclude repeated confessions, the illegal acts such as extorting confessions by torture are needed, which also have great impact on the accused, and greatly restrict his freedom to confession. After illegal confessions are excluded，it can be rebutted that repeated confessions are not admittable.If the prosecutor want to use the repeated confessions in the court，they should prove the causality does not exist.There will be many obstacles to exclude the repeated confessions. Therefore, the judicial independence of judges is needed so as to guarantee judicial justice.
