—基于9省市实证调研与数据挖掘的分析

【摘 要】“培育理性的司法文化，推进先进司法文化的社会化和大众化”是国家“2011 计划”司法文明协同创新中心的一项根本任务。基于9省市的实证调研与数据挖掘显示，我国司法文化的社会化和大众化程度不高，未来的司法改革和普法教育可在以下6个方面出现的问题上着力推进理性司法文化的培育：公众参与司法的意识很强但程度不高 ；公众诉诸司法的意识不强程度不高；公众接受司法裁判的意识不强程度不高；公众接受现代刑罚理念的意识不强程度不高；公众接受普法教育的方式不够多元；媒体对司法的监督与干预易造成“舆论审判”。

【Abstract】It is a fundamental task of Collaborative Innovation Center of Judicial Civilization to cultivate rational judicial culture and promote socialization and popularization of advanced judicial culture. Through empirical research and data mining within nine provinces, our research groups found that the socialization and popularization degree of our country's judicial culture is not high. In order to cultivate the rational judicial culture, we need to focus on the following six issues in the future judicial reform and the popularization of legal knowledge: the consciousness of the public participating in justice is very strong but the degree is not high; the consciousness of the public bringing an action is not strong and the degree is also not high; the consciousness of the public accepting the judicial referee is not strong and the degree is also not high; the consciousness of the public accepting modern philosophy of punishment is not strong and the degree is also not high; the way of popularization of legal knowledge is not enough diverse; there is often “Medium Justice” in the media’s supervision and intervention to justice.
