—以刑罚目的理论为指引

【摘 要】 我国当前量刑规范化改革过于重视已然犯罪的分析，忽略被告人将来行为的预测，过于重视量刑方法的精确化，忽视被告人个人情况的分析，不符合现代刑罚目的理论。刑罚目的理论经历了报应论、预防论与一体论的发展立场，不同理论对量刑皆提出了不同的要求。当代各国多提倡多元化的刑罚目的理论，我国也应当以此为鉴改造量刑程序。品性证据具有前瞻性优势和个别性优势，既符合多元化的刑罚目的理论，又足以弥补我国量刑规范化改革的缺陷，应当被引入并适用于我国量刑程序中。但是将品性证据适用于量刑，也难免存在一定的问题，包括品性证据可能影响定罪公正，品性证据现实形态略显混乱，品性证据的适用规则不明等，亟待进一步探索与研究。

【Abstract】The reformation of sentencing standardization in China is overly focused on the sentencing factor of the offense, and meanwhile ignores the prediction of defendants’ future behaviors. It also places too much emphasis on the accurateness of sentencing calculation methods, and overlooks the defendant’s personal situations. Such sentencing policy doesn’t meet with modern theory of punishment purposes. The theory of punishment purposes has shifted from retributive theory, deterrent theory, to integrated theory. Different theories have different influences on sentencing procedure. Nowadays many countries promote a diversity of punishment theories, which could be a lesson for China during its sentencing procedure reformation. Introduction of character evidence, which sheds light both on the behavior prediction and individual situation, not only meets with the diversity of punishment purposes theories, but also makes up for the defections the Chinese sentencing standardization reformation bears. Thus, character evidence should be introduced into Chinese sentencing procedure. However, some problems might exist when character evidence is applied in Chinese sentencing procedure. Character evidences may influence the fairness of conviction. The practical forms of character evidences are still in chaos. The rules of character evidence are not clear. Further exploration and research is in urgent need.
