【摘 要】 近年，医疗纠纷一直是社会热点问题，其中医疗损害鉴定是解决医疗纠纷的核心问题，也存在众多争议。本文通过对西周至明清、民国、新中国成立后三个时期医疗损害鉴定相关制度的梳理、国外医疗纠纷鉴定相关规定的总结，同时对江苏省、北京市、广东省三个地区 2016 年度医疗损害责任纠纷民事判决书的量化分析，探索我国医疗损害鉴定制度的改革，要明确辨析医疗纠纷相关鉴定的概念，建立独立的医疗损害第三方鉴定机构以及落实医疗损害鉴定机构的退出机制及其配套措施，以实现医疗损害鉴定的 公平、公正、公开。

【Abstract】In recent years, medical malpracticeinjury dispute has been a social hotspot. Medical malpractice injury assessment is thekeyto resolve medical malpractice disputes. Butmedical malpractice injury assessment is also a controversial issue. This paper combs relevant rules of medical malpractice injury assessmentapplied in the period from western Zhou dynasty to the Ming and Qing dynasty, the Republic of China, andthe period after the founding of new China,and summarizes the medical malpractice injury assessment regulations applied in foreign countries.Meanwhile the paper conducts quantitative analysis on medical malpractice court judgements collected from Jiangsu,Guangdong and Beijingof the year 2016.To explore a set of proposals formedical malpractice injury assessmentsystem reform, it needs clarification ofrelated concepts of medical malpractice injury assessment,establishment of independent third-party assessment institution, andimplementation of removing medical malpractice injury assessment institution. In that way,the medical malpractice injury assessmentwould be operated fairly, justly and openly.
