【摘 要】中国诸多司法评估项目基本都起到了“提供理想司法指引，发现司法运行问题，促进司法 良性发展”的作用，但在具体运行中仍然存在以下八大突出问题：司法评估目的容易出现异化，司法评 估主体的中立性不足，评估标准的普遍性与特殊性争议不断，主观指标与客观指标面临选择困境，指标 体系的构建忽视权重设置，调查方法的科学性不足，数据统计分析技术亟待提高，缺乏对数据的质量监 控和审查复核。对此，我们应从理论高度对司法评估的目的、主体、标准、体系、方法等各方面进行彻 底反思，才能保证司法评估结果的准确、可靠，从而促进我国司法公信力的提高，推动司法文明的建设。

【Abstract】Many of the judicial evaluation projects in China have basically played the role of“providing ideal judicial guidelines, discovering the problems in judicial practice, and promoting the sound development of justice”.However,there are still eight significant issues while implementing these projects: dissimilation of judicial evaluation purpose, insufficient neutrality of judicial evaluation subject, constant dispute soverthe universality and particularity of evaluation criteria, choice dilemma between objective and subjective indicators, ignorance of the weight-setting of indicator system,the lack of scientific investigation methods, the outdated data statistical analysis technology, and the lack of quality-monitoring and review process of the data.For these problems,we should thoroughly reflect on the purposes,subjects, criteria, system, methods and other aspects of judicial evaluation from theoretical perspective,so as to ensure the accuracy and reliability of evaluation results, thereby improving public trust in judicial system,and promoting the construction of judicial civilization.
