【摘 要】面对司法鉴定实践中对气枪弹模具的鉴定需求，简介当前气枪弹模具的常见结构与功能。 通过对涉枪刑事裁判文书中的鉴定需求与鉴定意见表达进行分析，说明在举证、质证、采信的各个环节， 气枪弹模具均有其认定犯罪事实的的证据价值。气枪弹模具尚未成为司法鉴定的对象。通过被告人供述、 物证、搜查笔录、证人证言等方式，能够实现对气枪弹模具的确认与功能说明。出于严格确认气枪弹模 具的功能与种类，遏阻其广泛散布的目的，有开展相关鉴定的必要性，并对可能产生的后续问题作出估 计。从气枪弹模具鉴定的技术可行性出发，提出可以采用的直接检验、功能检验与资料比对三种鉴定方 式。提出相关建议，以期为气枪弹模具鉴定意见作为法庭证据的适用形式提供更多思考。

Discussion on the feasibility and necessity of air gun pellets mold identification. 【Abstract】Facing the need of identification evidence of air gun pellets mold, this article begins with an introduction of the common structure and function of the current air gun pellets. Based on an analysis of the need of identification evidence in criminal trials and the form of such expert opinion, this article argues the identification evidence of air gun pellets mold bears probative value in determining the fact in a criminal charge in the processes of evidence production, evidence examination and evidence admission.Air gun pellets mold has not been recognized as a matter requiring proof of expert opinion yet. The identification and specifications of air gun pellets mold could be proved by other formats of evidence, such as defendant’s confession, exhibits, reports of search and seizure, witness testimony, and etc.It is necessary to carry out identification test for the purpose of strictly ensuring the function and pattern of the air gun pellets mold and deterring its wide spread.The identification test will also help to forecast the possible follow-up problems.In regard to the technical feasibility of procuring expert opinion on identifying air gun pellets mold, this article suggests three reliable test methods, including direct identification, functional identification and data comparison. Relevant suggestions are proposed in this article in the hope of providing more considerations for the courts adopting expert opinion on air gun pellets mold.
