【摘 要】《人民法院办理刑事案件第一审普通程序法庭调查规程(试行)》对证据与待证事实之间的关系及如何认定证据做了明确的规定。目前，在我国刑事诉讼中的勘验笔录在制作过程中还存在许多方面的问题。在司法实践中，法官对勘验笔录的审查判断亦存在诸多问题，导致出现认定事实错误。因此，有必要明确勘验笔录的证明力规则,从而倒逼侦查人员树立正确的证据理念，强化证据意识，防止审判 中将不具备证据要求的勘验笔录转化为定案的根据，进而预防和避免错案的发生。

【Abstract】The Regulations for Court Investigation of Ordinary Procedure Criminal Cases Handled by People’s Court of First Instance (for Trial Implementation)have clearly stipulated the relationship between evidence and facts to be proved, and how to determine evidence.At present, there are still many problems in the production process of the records of inquest in criminal proceedings.In judicial practice, there are also problems in judges’ examination on the records of inquest, which may lead to fact-finding errors.Therefore, it is necessary for us to establish attestation rules on the probative value of records of inquest. Moreover, it is helpful for investigators to establish correct understanding of evidence and to prevent the records of inquest that do not meet evidentiary requirements frombeing transformed into the basis for making a judicial decision on verdict, so as to prevent and avoid the occurrence of wrongful convictions.
