【摘要】人脸识别技术作为一种快速发展的生物特征识别技术已经在刑事侦查领域逐渐得到广泛的应用。其对侦查机关准确锁定犯罪嫌疑人、查明案件事实、提高侦查效率具有一定的积极意义。人脸识别结果作为证据进入刑事诉讼领域已经成为不可逆转的趋势。但人脸识别结果的证据化运用可能带来事实认定错误、“黑箱”效应等风险。为在充分发挥人脸识别技术优越性的基础上防范、化解人脸识别结果证据化运用可能存在的危险性，我国有必要在技术层面建立有关人脸识别的严格技术性规范，并在程序层面完善人脸识别证据的审前公开机制、贯彻直接言词原则的要求、完善专家辅助人制度、规范人脸识别证据的审查判断。

【Abstract】Face recognition technology,as a rapidly developing biometric recognition technology,has gradually been widely used in the field of criminal investigation.It is of certain positive significance to the investigation organs in accurately identifying the criminal suspects,finding out the facts of the case,and improving the investigation efficiency.Using facial recognition identity result as evidence in the field of criminal proceedings has been an irreversible trend.However,the evidential use of facial recognition identity result may lead to the risks of false fact finding,"black box"effect,and etc.Thus,necessary measures should be taken,in order not only to let the facial recognition to give full play to its advantage,but also to prevent and mitigate the possible risks brought about by the facial recognition identity result evidence.At the technology level,it is necessary to establish strict technical regulations on facial recognition.At the procedure level,it is necessary to improve the facial recognition evidence pretrial discovery mechanism,follow the principle of giving evidence in court,improve the expert auxiliary system,and standardize the review of facial recognition evidence.
