【摘 要】电子证据审查跨越法律和信息学科，涉及证据理论与司法实践的融通，故面临着跨域知识 从何而来的基础性问题。现代科学之父伽利略的实验思想对此有着重要启迪，可用以抽象出实验式审查 的专门做法。它指的是借助实验方法对电子证据进行审查的实验思维、便宜处置和实验室工作等，可以 按照审查目的、审查对象和审查对照进行不同的类型化。该方法的技巧是按照案件发生的近似条件开展 多轮电子证据实验，有效复现该证据所能证明的案件事实。我国应当推广基于实验范式的电子证据审查 方式，以促成办案人员专业能力的养成。

【Abstract】As a inter-disciplinary work of the law and information science, as well as the evidence theory and judicial practice, digital evidence review faces the fundamental problem of the sources of knowledge. The experimental thought of Galileo- the father of modern science provides an important enlightenment. Based on that, a specialized experiment method to review electronic evidence can be created. It refers to the experimental thinking, adapted disposal and laboratory work during the experimental review of digital evidence, which can be differently categorized according to the purpose, object and control of review. Its skill is to carry out multiple rounds of digital evidence experiments according to the approximate conditions of the case, and effectively reproduce the case facts that can be proved by the evidence. China should promote the digital evidence review method based on experimental paradigm, in order to nurture the professional ability of case handlers.
