【摘 要】对环境侵权诉讼关联性规则的理解与适用，司法实践中存在过度扩大解释关联的法律涵义、混淆适用关联性与因果关系以及错误拔高关联性证明标准的三大问题。缓解上述三大问题或从对关联性规则本身的考察出发，认识反社会性是关联性规则的关联介质，明确反社会性与关联性规则的关系以及对关联性规则的影响；从而在此基础上明确关联涵义、厘清关联性与因果关系界限的同时，确立以低度盖然性作为关联性规则的证明标准，构建常识型、科学技术确定型、技术不确定型、科学不确定型的关联性规则分类适用体系。在新型态的理解与适用体系下，不仅可以有效引导关联性规则明确且细化的应用，还能更好地维护社会公共利益这一更大的价值目标。

【Abstract】In judicial practice, there are three major problems in the understanding and application of the relevancy rule of environmental tort litigation: excessively expanding the legal meaning of relevance, confusing the application of relevance with causality, and wrongly raising the proof standard of relevance. To alleviate the above three problems, and to investigate the essence of the relevancy rule, we should recognize that anti-sociality is the medium of the relevancy rule, and clarify the relationship between anti-sociality and the relevancy rule and its influence; on this basis, the definition of relevance and the boundary between relevance and causality are clarified.At the same time, the low probability is established as the proof standard of the relevancy rule, and the classification and application system of the relevancy rule with common sense, scientific and technological certainty, technical uncertainty and scientific uncertainty is constructed. Under the new understanding and application system, it can not only effectively guide the clear and detailed application of the relevancy rule, but also better safeguard the greater value goal of social public interests.
