【摘 要】基于同侪压力与经济困难的双重困境，刑事案件中专家辅助人的出庭量极少。既无法实现对鉴定意见的有效质证也不利于保障当事人的对质权，使得刑事专家辅助人制度流于“书中之法”。刑事专家辅助人援助制度的构建是纾解上述困境之必要手段，通过国家公立援助化解当事人的经济窘迫，也保证更多的专家辅助人进入刑事案件之中。刑事专家辅助人援助制度在国家责任原则的主导下塑造，立法深意在于维护质证权于弱势群体中的平等适用。从援助范围、援助主体、援助程序、援助职能、管理模式、资金来源等方面探讨刑事专家辅助人援助制度的具体建构设想，以裨益于我国刑事专家辅助人制度的改革与完善。

【Abstract】Based on the double pressure from peer competition and economic constraints, the number of expert assistants attendance in criminal cases is extremely small. The system of criminal expert assistant turned to “law written in books” for it is impossible to not only effectively cross-examine the expert opinions but also to protect the parties’ right of cross-examination. The construction of criminal expert assistant aid system is the necessary way to relieve the above-mentioned dilemma, which means to resolve the economic distress of the parties through the national public assistance and to guarantee more expert assistants for criminal cases.The criminal expert assistant aid system is shaped under the principle of national responsibility, intended to maintain the equal application of cross-examination right among the vulnerable groups. To explore the specific construction ways of criminal expert assistant aid system from the aspects of assistance scope, assistance bodies, assistance procedures, assistance functions, management models, source of funds, etc. is beneficial to the system improvement in our country.
