【摘 要】庭审笔录的正确适用对于厘清案件事实争议具有重要的证据法意义。当前，刑事庭审笔录虽未在立法规范上明确划分为法定证据，但从证据法视域观察，其符合法定证据种类的基本属性与内在要件，在证据归属上可采取一种妥协处理方式划分。对刑事庭审笔录进行现状检视，发现其存在部分质证和认证难题。刑事庭审录音录像和庭审笔录应归属于同一类证据，且庭审录音录像并不能完全替代庭审笔录，而仅是表现形式之一。在司法适用中刑事庭审笔录能够对程序性事实、实体性事实和量刑性事实发挥不同程度的证明作用。针对刑事庭审笔录存在的司法适用问题，具体完善可从相关规则的建构为切入点，包括明晰庭审笔录的阅卷及使用规则，设置庭审笔录的质证方式以及明确庭审笔录的审查重点。

【Abstract】The correct application of court transcript is of great significance in the law of evidence for clarifying the disputes over of facts of the case. Although, currently, the criminal court transcript is not clearly classified as evidence, from the perspective of evidence law, such transcript conforms to the basic attributes and inherent elements of evidence type declared by law. We can adopt a compromise approach to incorporate the transcript into evidence. By examining the current application of criminal court transcript, it is found that there are some problems in cross-examination and authentication. The audio and video recording of the criminal court hearing and the court transcript should be the same type of evidence. The audio and video recording, which cannot completely replace court transcript, is only one manifestation of court transcript. In judicial process, the criminal court transcript can play a significant role in proving procedural facts, substantive facts and sentencing facts. At present, the application of criminal court transcript still encounters many problems. The improvement can be fulfilled by establishing new evidence rules, including clarifying the rules for reviewing and using court transcript,establishing the cross-examination method of court transcript, and clarifying the review focus of court transcript.
