【摘 要】随着科学技术的进步和社会的发展，不同学科对诉讼活动的渗透不断加深。技术性证据作为科技与法律融合的产物，具有专业性、科学性等特征，往往会直接影响案件的走向以及定罪量刑。当前，网络犯罪、环境污染以及侵犯知识产权案件等专业领域的新型案件数量激增，而且各类案件涉及的专门知识类别多样，如法医、电子数据、司法会计和视听资料等，大量涉及技术性证据的问题已超出一般检察官的经验以及知识储备，因而必须要借助专业技术人员对案件中的技术性证据进行专业审查。然而，法律的缺位导致检察机关技术性证据审查工作的开展无法可依，审查程序不规范，审查内容和方式不统一。同时，由于检察技术队伍力量不足，检察机关需要借助社会鉴定力量，在委托审查时容易出现责任分配不清、权责不明等情况。现实迫切需要在改革实践中健全符合办案需要的技术性证据审查机制，出台全国统一的工作规范，提高检察技术人员审查能力，构建完善的委托外部审查制度，帮助检察官依法正确履行职权，确保办案质量，提升司法公信力。

【Abstract】With the advancement of science and technology and the development of society,the penetration of different disciplines into litigation activities is deepening. As the product of the integration of technology and law, technical evidence has the characteristics of professionalism and scientificity, which often directly affects the trend of the case and the conviction and sentencing. At present, the number of new types of cases in professional fields such as cybercrime, environmental pollution and intellectual property infringement cases has surged, and the types of expertise involved in various cases are diverse, such as forensics, electronic data, forensic accounting and audio-visual materials. A large number of issues involving technical evidence have exceeded the experience and knowledge reserve of prosecutors, so professional technicians must be used to conduct professional review of technical evidence. However, the absence of law has led to the lack of legal basis for the examination of technical evidence by the procuratorial organs, irregular review procedures, and inconsistent review content and methods. At the same time, due to the insufficient strength of the procuratorial technical team, the procuratorial organs need to rely on the power of social appraisal. But, it is easy to have unclear distribution of responsibilities and unclear rights and responsibilities when entrusting the review.In reality, there is an urgent need to improve the technical evidence review mechanism that meets the needs of case handling in the practice of reform, introduce national unified working norms, improve the review capabilities of procuratorial technicians, and build a complete system for entrusting external review to help prosecutors correctly perform their functions and powers in accordance with the law, ensure the quality of case handling and enhance judicial credibility.
