【摘 要】作为典型的程序性制裁措施，重复供述排除规则承载着震慑违法取证和人权司法保障的共向价值。在言词证据形成阶段，非法取证与重复供述之间间隔的时间距离，使得研判继续效力产生、稀释和中断的过程愈加复杂。依托审讯和供述心理学的认知—行为模型解构证据规则可以发现，应急源的局限范围和介入因素地僵化套用，极大地压缩了证据规则的司法适用空间，亦减损程序制裁的实际震慑效果。在亟待厘清重复供述审查模式的我国，有必要汲取大证据学学理体系所倡导的整合多学科认知原理和复合经验，一方面构建以综合研判应激源和介入因素的实质审查模式，另一方面规范证据合法性审查程序，并借助指导案例制度提升法官释法能力。

【Abstract】As a typical procedural sanction measure, the exclusionary rule of repeated confession bears the common value of deterring illegal evidence collection and judicial protection of human rights. In the formation stage of verbal evidence, the time interval between illegal evidence collection and repeated confession complicates the research and judgment process of the generation, dilution and interruption of the continuous effectiveness. By deconstructing the evidence rules based on the cognitive-behavioral model of interrogation and confession psychology, it can be found that the limited scope of stressors and the rigid application of intervention factors have greatly compressed the judicial application space of evidence rules and reduced the actual deterrent effect of procedural sanctions. In China, which urgently needs to clarify the review mode of repeated confession, it is necessary to learn from the integrated multidisciplinary cognitive principles and compound experience advocated by the comprehensive evidence theory system. On one hand, it is necessary to set up a substantive review mode based on the comprehensive research and judgment of stressors and intervention factors, on the other hand, it is of necessity to standardize the review procedure of evidence legitimacy, and improve the judge's interpretation ability with the help of guiding case system.
