【摘 要】世界反兴奋剂运动正在按部就班推进，但对运动员采集血样应当遵守指南、所在地法律的声音愈来愈强烈。《世界反兴奋剂条例》是体育界反兴奋剂的基本法律，具体操作和要求应当遵守ISTI及《血样采集指南》。血样采集操作会影响检测结果的准确性，也会影响运动员的健康和训练，因而应当遵守《条例》、ISTI、指南以及所在国的法律、操作规范。指南是ISTI的扩展，原则上应当遵守，特殊情况可以例外但应当有理由。笔者建议我国体育行政管理部门应当重视法律顾问工作，加强合法合规审查；完善我国的运动员兴奋剂检测的相关工作制度；加强与国家卫生健康委等有关部门、国际体育组织沟通。

【Abstract】The World Anti-Doping Movement is advancing step by step. However, there is an increasingly  stronger voice that blood samples should be collected in accordance with Blood Sample Collection Guidelines and local  laws. The World Anti-Doping Code (WADC) is the basic law of Anti-Doping in sports circles. The specific operation and  requirements of blood samples collection should comply with the International Standard for Testing and Investigations  (ISTI) and Guidelines for Blood Sample Collection. The operation of blood sample collection will affect the accuracy  of the test results, as well as the health and training of athletes. Therefore, it is necessary to abide by the WADC, ISTI,  Blood Sample Collection Guidelines, and local laws and operation specifications. Blood Sample Collection Guidelines  is an extension of ISTI and should be abided by in principle. Non-compliance with the guideline only occurs for  certain reasons. The author suggests that China's sports administrative department should take work of legal advisers  seriously, strengthen review on legal compliance, improve relevant working system of doping test on athletes, and  increase communication with relevant departments, such as the National Health Commission, and international sports  organizations.
