【摘 要】 随着精神疾病成为严重的公共卫生和社会问题，刑事诉讼中有精神障碍的犯罪嫌疑人和被告人的权利保障问题也日益得到社会关注。本文在报告实证调研发现的基础上进行了法律社会学的分析,试图为读者展示刑事诉讼实践中精神病鉴定的运作情况和存在的主要问题，并针对法律缺失提出改革完善的对策。

【Abstract】 Mental health has become not only a public health issue but also a serious social problem. Thus more and more attention has been paid to the rights protection for suspects and defendants with mental illness in criminal cases. This article reports the preliminary findings of an empirical research project focusing on procedural safeguards for mental health assessment in criminal cases, provides analysis from perspective of legal sociology,tries to illustrate how the mental health assessment operates in practice and what problems exist with this proceeding, then puts forward some reform proposals in response to the existing problems.
