【摘 要】司法实务中实行的“由供到证”的证据审查顺序以及在此基础上形成的“以证印供”式证明思路，是“口供中心主义”的体现，容易导致承办人“先入为主”，形成有罪预断，进而导致错案。因而，证据审查、判断应当遵循先审查客观证据，再审查主观证据，最后审查犯罪嫌疑人、被告人的供述和辩解的顺序。对于同一类型的证据，则应当按照证据生成的时间先后为顺序进行审查、判断。物证、书证应当与证明其来源的笔录类证据一并加以审查。

【Abstract】The order of the evidence review-“from confession to evidence” -in judicial practice and the prove logic of “confirming the evidence by confession” are the reflection of “the principle on confession centralism”, which makes the undertaking judge being “prejudiced by first impression”, and creates guilty prejudgment and further generates wrong convictions. Therefore, evidence review should follow the order of reviewing objective evidence firstly, then reviewing subjective evidence, and finally reviewing the defendant's confession and defense. For the same type of evidence, we should review them in chronological order of their formations. Material evidence and documentary evidence should be reviewed together with the depositions which can be used to prove their source.
