【摘 要】在全国性医疗损害技术鉴定规范尚未出台的背景下，各省市制定的地方鉴定指导文件在相当程度上影响着医疗损害技术鉴定实践，其内容涉及医疗损害鉴定的各个环节，为制定统一的医疗损害技术鉴定规范提供了有益经验。然而，目前地方鉴定指导文件中存在的法律层级过低、内容不统一等问题制约了医疗损害技术鉴定的开展，迫切需要制定全国性的规范性文件并就争议问题作出明确规定。

【Abstract】As the national regulations on appraisal for medical malpractice has not been issued yet, local guiding documents to some extent play an important role in medical tort appraisal practice. The contents of these documents involve in all aspects of medical malpractice appraisal, and through the enforcement of these documents, much beneficial experience can be learned from when drafting the national standards. However,binding effect of local document is limited, and there are conflicts between different local documents. It is of urgent need to develop national standard and to make clear provisions on contentious issues.
