【摘 要】 20 世纪 70 年代末我国现代法制步入历史正轨之后，人民法院逐渐恢复与重建了司法技术工作。在 2005 年全国人大常委会颁布《关于司法鉴定管理问题的决定》之前，人民法院司法技术工作的主要功能倾向于司法鉴定。从 2005 年司法鉴定管理体制改革开始，人民法院司法技术辅助工作机构就不再开展司法鉴定工作，由此启动了司法技术工作的去鉴定化转型，以及司法技术工作非鉴定化的功能重组。然而，人民法院当前司法技术工作的功能实践，却分别受制于司法技术资源供给不足、司法技术功能相对有限以及司法技术工作机制尚不健全等多重因素的制约。因此，人民法院司法技术工作的功能完善，需要从司法技术的资源配置、司法技术的功能拓展、司法技术的工作机制健全等方面进行系统化的制度建构。

The functional change and perfection of the judicial technical work of the People's Court. Tu shun Southwest University of political Science and Law, Chongqing 401120

【Abstract】After the modern legal system of our country entered the right track in the late 1970s,the people's court gradually resumed and rebuilt the judicial technical work. Before the Decision on the Administration of Judicial Appraisal promulgated by the standing Committee of the National people's Congress in 2005, the main functions of the judicial technical work of the people's courts tend to be judicial appraisal.Since the reform of judicial appraisal management system in 2005, the judicial technical department of the people's court terminated theenforcement of judicial appraisal, which has initiated the de-identification trend of judicial technical work and the functional reorganization of judicial technical work. However, the functions of the current judicial technology work of the people's court are limited by the insufficient supply of judicial technology resources, the functions of judicial technology are relatively limited and the unclear rights and responsibilities between the internal departments of the court. Therefore, the improvement of the function of the judicial technical work of the people's court needs to be systematically improved from the aspects of the construction of judicial technical organization resources, the expansion of the judicial technical function, the working mechanism and process of the judicial technical work, and so on.
