【摘 要】司法部公共法律服务管理局于 2019 年 10 月 8 日发布的《鉴定人出庭作证规定（征求意见稿）》第一次比较系统地对鉴定人出庭作证的相关问题作了细致规定，但仍然存在诸多问题：在整体立法上，存在未重视首条的提纲挈领作用、法律属性定位不明、未考虑三大诉讼的不同特点、部分条文顺序应调整等问题；在关键概念的界定上，鉴定人的范围应扩大，具有专门知识的人、专家证人与专家辅助人等之间的区别需进一步厘清，宜采用专家辅助人的概念；在权利义务的规定方面，存在规定不清、不合理、明显错误和遗漏重要规定等问题；在具体程序规定方面，缺少对鉴定人询问的启动程序规定，对回避的规定也不完善，对鉴定人负有人身保护义务的职能部门规定不够明确，只强调对鉴定人的事前事中保护，缺乏对出庭之后和诉讼终结之后的保护规定。

Rethinking and remodeling: Some suggestions on the revision of the regulation for judicial appraiser to testify in court (Draft for Soliciting Opinions). Associate Professor of Law School of Beijing Jiaotong University, Beijing 100044.

【Abstract】On October 8, 2019, Public Legal Services Administration of Ministry of Justice released the Regulation for Judicial Appraiser to Testify in Court (Draft for Soliciting Opinions), which systematically regulated the related issues of judicial appraiser to testify in court in the first time, but there are still many problems: on the whole legislation, there are not attaches great importance to the framing effect of the first article, the legal attribute is mixed, the draft not considering the different characteristics of three major litigation, some clauses sequence should be adjusted, etc. In the definition of key concepts, the scope of judicial appraiser should be expanded, the distinction among person with special knowledge, expert witness and expert assistant should be further clarified,and the concept of expert assistants should be adopted. In the provision of rights and obligations, there are unclear, unreasonable, obvious errors and omission of important provisions and other problems. In terms of specific procedural provisions, there is a lack of provisions on the initiation procedure for the inquiry of judicial appraiser,and the provisions on the avoidance are not perfect. The functional departments with habeas corpus protection obligations for judicial appraiser are not clear enough. The Draft only emphasize the protection of expert witnesses before and in court, but lack of provisions on the protection of expert witnesses after appearing in court and the conclusion of litigation.
