　　【摘 要】 目前我国的艾滋病流行现状不容乐观，且其具有极大的社会危害性。《最高人民法院、最高人民检察院关于办理组织、强迫、引诱、容留、介绍卖淫刑事案件适用法律若干问题的解释》(以下简称为《解释》)的颁布，可以有效的预防和减少故意传播艾滋病的行为，更好的控制艾滋病的发展趋势，且弥补了我国法律在这方面的不足。但是其未涵盖全部故意传播艾滋病的行为，且未规定如何对被害人人身损害程度进行鉴定。因此，本文对涉及故意传播艾滋病问题的相关法律及司法鉴定实务进行研究，探讨不同类型故意传播艾滋病行为的刑罚处罚问题以及被害人损伤程度鉴定等司法实务问题，并提出相关建议。

　　A study on the judicial appraisal practice related to intentional transmission of AIDS. 　　【Abstract】 The current situation of AIDS epidemic in China is overwhelmingly worrisome. AIDS epidemic presents great social harm. The promulgation of the “Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in the Handling of Criminal Cases Regarding Organization, Coercion, Seduction, Shelter and Introduction of a woman to Prostitution”(hereinafter referred to as the “Interpretation”), can effectively prevent and reduce intentional transmission of HIV/AIDS, and better control the trend of HIV/AIDS spread. This interpretation makes up the legislative deficiency in this field. However,this interpretation neither covers all types of intentional transmission of AIDS, nor specifies how to evaluate the degrees of personal injury suffered by victims. Therefore, this paper studies relevant laws and judicial appraisal practice related to intentional transmission of AIDS, discusses penalties for different types of intentional transmission of AIDS, and the judicial appraisal on victim's injury degree. This paper finally puts forward relevant suggestions accordingly.
